Federal - Business

The Federal Business Immigration policy is based on attracting the most qualified senior managers or business owners to immigrate and live in any province in Canada other than the Province of Quebec which has its own full-fledged immigration program and processing requirements.

The Federal System covers three main categories and information on each is provided to allow you to see which one best suits your business background, financial ability and investment potential as applicable.

Business Entrepreneur

The Immigration and Refugee Protection Act of Canada, 2002, states the following with respect to Business Entrepreneurs, who based on their ability to become economically established, may apply for permanent resident status:

"An entrepreneur other than an entrepreneur selected by a province, means the management of a qualifying business and the control of a percentage of equity of the qualifying business for at least 2 years in the period beginning five years before the date of application for a permanent resident visa and ending on the day a determination is made in respect of the application."

An Entrepreneur Must Meet the Following Conditions to Qualify:

- Has business experience as outlined above;
- Has a legally obtained minimum net worth of at least CDN$300,000;
- Is willing to start, purchase or invest in a “Qualifying” Canadian business within 3 years of landing in Canada for a minimum period of 1 year and make this business successful
- Meet the required points assessment to qualify for immigration

A conditional visa is issued with a condition on the applicant and his/her family members to meet the business establishment conditions or face the possibility of removal from Canada for non-compliance.

Business Investor

The Immigration and Refugee Protection Act of Canada, 2002, states the following with respect to Business Investors, who based on their ability to become economically established, may apply for permanent resident status:

"An investor other than an investor selected by a province, means i) the management of a qualifying business and the control of a percentage of equity of the qualifying business for at least two years in the period beginning five years before the date of application for the PR visa and ending on the day a determination is made in respect of the application, or ii) the management of at least 5 full-time job equivalents per year in a business for at least two years in the period beginning five years before the date of application for a PR visa and ending on the day a determination is made in respect of the application."

An Investor Must Meet the Following Conditions to Qualify:

- Has business experience as outlined above;
- Has a legally obtained minimum net worth of at least CDN$800,000;
- Is willing to make a one time investment with the government of Canada of CDN$400,000 for a period of 5 years, on conclusion of which, a full refund of the investment about with no interest is paid back to the applicant. A loan option is available to meet the investment requirement.
- Meet the required points assessment to qualify for immigration.

An unconditional visa is issued with no conditions on the applicant and his/her family members whatsoever.

Business Self Employed

The Immigration and Refugee Protection Act of Canada, 2002, states the following with respect to Business Self Employed applicants, who are persons with relevant experience and who intend to and have the ability to be self-employed in Canada, may apply for permanent resident status:

"A self employed business person other than a self employed person selected by a province, means someone who will make a significant contribution to specified economic activities in Canada, such as the arts, cultural activities, athletics or the purchase and management of a farm."

A Self Employed candidate Must Meet the Following Conditions to Qualify:

Has experience and will contribute to activities or purchase and manage a farm as outlined above;
Has sufficient funds, a business plan or proof of their proposed activities in Canada;
Meet the required points assessment to qualify for immigration

An unconditional visa is issued with no conditions on the applicant and his/her family members whatsoever.
